Employers can Sponsor overseas workers for the Temporary Skill Shortage (subclass 482) and  Sponsor overseas workers for permanent residence under the Employer Nomination Scheme (subclass 186) visa program in direct care occupations.

Job Prospects and Skill Assessments

Congratulations to all those whose skills assessments were successful! We are happy to report that all our clients we applied were approved.

While only 3-5 employers were subscribed when we contacted you last year, we are pleased to announce that 25 (and now approximately 40) employers are approved sponsors. However, this number is still small, and large-scale employers have not yet applied for aged care worker sponsorship approval, resulting in significant aged care worker vacancies in Australia.

We recognize the immense demand from overseas care workers for Australian jobs. The overwhelming demand from potential applicants, currently exceeds the number of approved sponsors. Despite this, thousands of job vacancies remain open in the Australian aged care industry.

To manage this high interest, we have established a priority list based on your registration date. We are gradually working through this list chronologically. This will cause delays, and as indicated in the past we cannot guarantee if employers will select you to be interviewed or after interviewed whether you will be selected for employment. That is beyond our control.

We are actively seeking additional opportunities by collaborating with recruiters and directly liaising with employers. Please note, we will be only contacting candidates who are offered interviews for jobs.

We encourage you to proactively seek employment independently. If you secure a position, we will gladly assist with your visa process.

We do not respond to individual inquiries about your job prospects, due to the overwhelming demand, inquiry emails will hinder any progress. We will contact you directly if an employer is interested in you.

We remain optimistic that more employers will join the program, creating further opportunities in the future.

Annual Salary

  • Annual salary of at least $51,222 AUD or the Australian Market Salary Rate, whichever is higher.

We can assist employers to access the Aged Care Industry Labour Agreement, organising an MoU with the relevant unions(s):

  • Access the following concessions to standard skilled visa requirements:

    • Permanent residence two year pathway to permanent residence through the Employer Nomination Scheme
    • streamlined visa nomination and priority visa application processing
    • no post qualification work experience requirement

English language requirement:

    • English language concessions for workers with relevant community language skills.

Key visa application requirements:

Skill level

    • hold a relevant AQF Certificate III or equivalent, or higher qualification. You can also have 12 months of relevant work experience or part time equivalence.

Skills assessment

Skill and qualification requirements will differ from those stipulated in ANZSCO. These will be specified under the terms of each Labour Agreement.

English language proficiency

    • IELTS 5.0 or equivalent.
    • IELTS 4.5 or equivalent – Workers with target community language skills employed by culturally and linguistically diverse aged care providers

Labour market testing

    • Labour market testing requirements is satisfied once aged care providers have entered an MoU with the relevant union(s).

Fee estimations will be provided in writing after our assessment. The full non-visa process is not mapped out yet. I.e., the skills assessment body is not ready yet. Once the full process is implemented this web site will be updated.

Skills assessment – Australian Nursing and Midwifery Accreditation Council [ANMAC]

Applicable Occupations: Nursing Support Officer and Personal Care Assistant occupations only.

Requirements

01. To be eligible applicant must have:

      • Minimum Australian Qualifications Framework (AQF) Certificate III in a relevant area that has been obtained overseas, including nursing-associated or work in aged care study.

or

      • Full-time paid work experience of at least 12 months within the previous five (5) years.

If you have an AQF Certificate III:

      • Graduation certificate itself.
      • Transcript confirming completion.

* Nursing qualifications overseas that is a completed qualification that has been finalised into a professional registration – then you are eligible to apply for the Direct Care Occupation Skills Assessment. But there will need to be evidence of the overseas nursing qualification/registration. Any other nursing-type qualifications will be accessed by ANMAC on an independent basis.

      • the relevant authority can post the verification directly to ANMAC at verification@anmac.org.au and must cc us at info@dlegal.com.au.

CHECKLIST

      • A professional written reference provided through a nursing supervisor. This is a vital component if you have chosen this option. Reference consists of your job in the full-time paid work, the tasks in relation to your role and includes the duration of time (hours and dates) during your employment.
      • Ensure there is your referees work email address and have consented to being contacted by ANMAC to provide verification to your employment claim. Important to note that company’s letterhead must be utilised when providing reference. Also note that:
          • Must include main email addresses only – not inclusive of web-based email address that is on a free application.
          • Statutory declarations will be rejected instead of formal documentation.
      • A service statement presented by your employer validating your employment.
      • Two (2) payslips and/or tax statements for evidence of payment.
      • Your employment contract/(s).
      • ANMAC rejects work experience received in cash payment.
      • Ensure that ANMAC must be able to verify your work experience claim. If there is fraud found, it will result in an unfavourable skills assessment result, and a penalty of two (2) year locked period for another skills assessment.

03. Provide supporting documents:

      • Coloured copy of passport
      • Passport sized photo, in colour and on a white background – produced within the last 6 months.
      • Change of name document (if required)
      • Certified copies of at least two (2) other official identity documents including one official photo bearing ID such as:
        • Birth certificate
        • Australian visa or immicard.
        • Driver license or ID card issued by country of citizenship.

04. Provide Agent Declaration (If you nominated an agent to act on your behalf):

    • Signature provided by both the migration agent and the applicant.

05. Completing the Direct Care Occupation skills assessment application: 

    • DLegal will undertake the process by initiating the application.

Aged or Disabled Carer common job occupations include: Aged Care Worker, Disability Care Worker, Personal Care Worker, Carer, Personal Carer, Individual Support Worker, Disability Support Worker, Disability Development and Support Worker, Community Support Worker (Disability Assisted Living), In-Home Support Worker/Carer, Community Care Worker, Home Support Worker, Domestic Support Worker.

01. Eligibility criteria

A relevant qualification obtained overseas which is equivalent to a minimum Australian Qualification Framework (AQF) Certificate III or higher and includes a relevant vocational placement/practical training.

A relevant qualification will typically cover the following:

    • Provide personalised support and person-oriented services.
    • Support aged/disabled persons independence and well-being.
    • Enable participation with community and providing a sense of social inclusion.
    • Work within a diverse range of people.
    • Work in a legal and ethical environment.
    • Follow practices in safe work.
    • Ensure personal needs support is met.
    • Aid family and friend’s relationships.
    • Work with people who have mental health/ dementia issues.

or

if you do not have a relevant qualification, twelve (12) months of relevant full-time work experience, or part-time equivalent, in Australia or overseas working as an Aged or Disabled Carer (can be one obtained overseas or an overseas qualification equivalent to an Australian one).

    • Position descriptions that is official for pertinent work experience. Applicants need to provide this evidence for all work experience claims made within the application.
    • Letter by an employer (known alternatively as a statement of service) depicting details of the position with the title, employment classification (full-time, part-time, or casual), hours worked per week, and start and concluding dates of employment. Note that the letter needs to be dated. Mandatory for applicants to provide this evidence for all experience claims related to work that is made in the application.
    • Present CV/resume including two (2) referees with their present contact details, one of the referees must have been your workplace supervisor.

    • Evidence of your applicable qualification with provided date within the previous four (4) years.

    • Employer letter (statement of service) showing minimum of three (3) months of applicable work completed in the last eighteen (18) months and position description of an official level for the industry experience.

*ACWA has the rights for the need of additional information to support or supplement evidence towards claims. Can be inclusive of additional copies regarding bank statements, third party verification or copies on salary pay slips.

English Language Requirement

TSS (482) visa: overall score of IELTS 5.0 (or equivalent), with a minimum individual band scores of: o 5.0 for Speaking and Listening o 4.5 for Reading and Writing.

Other accepted English language tests are:

    • Occupational English Test (OET);
    • Test of English as a Foreign Language internet-based test (TOEFL iBT);
    • Pearson Test of English (PTE) Academic test; or
    • Cambridge English: Advanced (CAE) test.

  1. What does “Professional Verification” mean?
  • Verification of overseas registration, also known as a certificate of good standing. A verification of registration, or certificate of good standing letter, confirms that your registration is valid and that you have no issues against your practice as a nurse and/or
  1. I am a private sector Nurse and had PHSRC registration, so should I take this verification from the PHSRC?
  • Yes, the nursing and midwifery councils responsible for registering nurses and midwives in each country or jurisdiction can provide this

  1. What is a Professional reference letter?
  • A recommendation letter written by a nursing supervisor/manager. The reference must describe your role, and the tasks you undertake and provide the dates and hours of your employment. The service letter is acceptable under the professional reference format for already concluded employment.
  1. When should I pay the cost of assessment of $545?
  • When we are about to lodge the skill assessment
  1. I couldn’t have reference letters from nursing staff, but I have letters from 2 consultants who worked with me. Is it enough or should I take letters from nursing superiors?
  • The requirement is as stated. If you are unable or cannot provide the professional reference accordingly that will weaken your skill assessment but if you are not able to provide it from the nursing supervisor best thing is to provide the professional reference as you have mentioned according to the ANMAC standard way. But we do not recommend this.
  1. Do we need to attest the Birth certificate, Bio page of the passport, and NIC from the Foreign Ministry for Skill assessment.??
  • Certified true copies are sufficient.
  1. Should I courier my good standing certificate to ANMAC?
  • Please ask the regulatory authority to post or email a verification of registration or certificate of good standing letter directly before lodging the application. ANMAC does not accept a photocopy, fax, or scanned copy of the letter from you or any other
  1. How do I sign the agent authorization form?
  • Please download the form from the website to fill out and
  1. What information does my professional reference need to provide?
  • On official letterhead, your professional references need to provide:
    • your dates of employment
    • your areas of experience
    • a statement about your professional competence and safety as a nurse or midwife
    • examples of your professional competence as a nurse or midwife (the day to day activities you undertake) related to the tasks required for your ANZSCO code details of continuing professional development
    • signature of the referee (electronic signatures are not acceptable).
    • Your referee needs to date their original letter and include their name, position and contact details. The contact details should include an official email

You should use the person who directly manages or supervises you. This person must be a nurse, midwife or clinical supervisor. If your direct supervisor is not a nurse or midwife, a statement to this effect should be included in the reference. We do not accept references from Human Resources or Payroll departments.

  1. I possess a BSc. Nursing (Hons) and it has not been included in professional verification. Is there any negative impact on my skill assessment and further processes?
  • It will be advantageous to have additional qualifications; however, obviously, and practically, it may cause more work and time if there are more qualifications to be assessed. If you are able to meet the requirements without the BSc, it may be okay not to submit for the skills
  1. Do I need to submit a professional reference?
  • If you would like ANMAC to report on your work for points recognition by the Department of Home Affairs, you will need to submit professional references that meet ANMAC criteria. You must have a minimum of 1 year of paid work in Australia and/or a minimum of 3 years of paid work Work experience will not be considered if there is no corresponding nursing registration in that jurisdiction at that time.

Visa Pathway Steps and Employment

Step 1: Registration and professional assessment

In this step, we will register you and categorise you according to your background and the next activity [i.e., [A] Full Study pathway [B] Gap study [RPL/CT] pathway [C] Skills assessment.

Within 4 to 5 weeks, you will receive an email with our assessment outcome and inform you of the next steps and fees. [i.e., either undertaking studies for certificate III or preparation for the skills assessment]

Fee: 150Aud

A.    Study pathway
We will arrange a Certificate III study [with a possible option for professional experience placement in Australia if required].  Thereafter you may be required to undertake a skills assessment if you have not studied in Australia. Next is a potential job placement with an Australian employer with a minimum of $51,222 AUD under the Aged Care Industry Labour Agreement pathway, which has a PR pathway.

B.    RPL or CT pathway
Internationally qualified nurses (RNs, GNMs, ANMs, PCL nurses) can receive RPL [Recognition of Prior Learning with Credit Transfer] for an Australia Certificate III with the possibility of professional experience placement in Australia.].  Thereafter you may be required to undertake a skills assessment if you have not studied in Australia. This opens a potential job placement with an Australian employer with a minimum of $51,222 AUD under the Aged Care Industry Labour Agreement pathway which has a PR pathway.

C.   Skills assessment
If you have relevant qualifications and or relevant work experience, we will proceed to obtain such a qualification [You may have to follow the steps above]. Thereafter you may be required to undertake a skills assessment if you have not studied in Australia. This opens a potential job placement with an Australian employer with a minimum of $51,222 AUD under the Aged Care Industry Labour Agreement pathway, which has a PR pathway.
