Start Your Will Instructions Online

Plan for your family, assets and future wishes with an estate plan tailored to your circumstances.
DLegal advises individuals, couples, families and business owners across Melbourne and Victoria on wills, testamentary trusts, powers of attorney and related estate-planning matters.

A will is an important part of estate planning, but a will alone may not be enough.

What is estate planning?

Estate planning involves deciding how your assets and affairs should be managed if you die or lose decision-making capacity. Depending on your circumstances, an estate plan may include a will, a testamentary trust, an enduring power of attorney, an appointment of a medical treatment decision maker, superannuation death benefit nominations, and appropriate arrangements for personally and jointly owned assets.

Could a Testamentary Trust Will Benefit You?

A Testamentary Trust May Offer Additional Benefits.

A will incorporating a discretionary testamentary trust may provide greater flexibility and protection for beneficiaries, depending on their circumstances.

It's smart because it may provide and protect:

  • provide beneficiaries with greater flexibility in managing an inheritance;
  • offer a degree of protection where a beneficiary experiences bankruptcy, financial difficulty or a relationship breakdown;
  • provide potential taxation advantages;
  • assist with planning for vulnerable beneficiaries or beneficiaries with a disability; and
  • allow for rights of residence and other tailored arrangements.

These benefits are not automatic and will depend on the beneficiary’s circumstances, the terms of the will and the law applying at the relevant time.

  • Basic Will

A basic will may be suitable where your circumstances and wishes are straightforward. If spouses or partners have substantially similar circumstances and wishes, they may use one questionnaire to provide their preliminary information. However, each person is a separate will-maker and must independently confirm and approve their instructions and final will.

  • Complex Will

Separate questionnaires are generally required where the will-makers have different wishes or where their circumstances involve a blended family, trusts, companies, taxation considerations, vulnerable beneficiaries or other complexities.

If you cannot use the online questionnaire because of accessibility requirements or technical difficulties, please contact us. To qualify for the promotional offer, the alternative questionnaire must ordinarily be returned within the same three-calendar-day period. Please:

  • type your answers directly into the document;

  • do not print and scan the document.

Conditions, Important Information and Disclaimers

  • Submitting the completed online questionnaire does not, by itself:
    • create a solicitor–client relationship, engage DLegal or require DLegal to act for you; or
    • constitute legal advice specific to your circumstances.
  • DLegal will only be formally engaged after completing any required conflict checks, accepting the engagement and receiving the relevant signed engagement documents.
  • The questionnaire and attached guides contain general information only. They do not constitute legal advice concerning your particular circumstances. You should not make any legal, financial or other decision, or take any action, solely on the basis of that information.
  • DLegal does not provide financial, investment, accounting, taxation or superannuation advice. Where appropriate, such matters should be considered with an appropriately qualified financial adviser, accountant or taxation professional before finalising your estate plan.
  • The suitability and effectiveness of any Will, testamentary trust or other estate planning document, arrangement or option will depend on your personal circumstances, the final terms of the relevant documents and the law applying at the relevant time. Taxation, asset-protection, social-security, government-benefit and other outcomes cannot be guaranteed.
  • Your information will be handled in accordance with DLegal’s privacy and confidentiality obligations and its Privacy Policy.

Eligibility for the complimentary initial estate planning interview and exclusive online rates is subject to:

  • submission of the completed questionnaire within the applicable three-calendar-day period;
  • provision of preliminary instructions through the online process or an approved alternative arrangement; and
  • the terms, scope and validity period stated in the Online Rates Schedule.

The complimentary initial estate planning interview:

  • is limited to 20 minutes;
  • is conducted by telephone or Zoom;
  • is intended to clarify your preliminary instructions and discuss possible next steps; and
  • does not include comprehensive legal advice, document review or written advice.

Fee Estimates Disclaimers

Published fees and estimates are based on basic, non-complex circumstances and on the required information, documents and instructions being provided through our online process. The published estimate may not apply if your matter is complex or you require an alternative method of providing instructions. Please contact us to discuss any reasonable adjustments or alternative arrangements and to obtain an appropriate estimate before work begins.

Any estimate of total legal costs is not a fixed quote or cap. The actual legal costs and disbursements may exceed the estimate if your instructions or the scope of work change, the matter becomes prolonged or more complex, or further information or circumstances arise. If there is a significant change affecting a previous disclosure, we will notify you in writing as soon as reasonably practicable and provide a revised estimate.
