  1. PUBLIC INTEREST CRITERION (PIC) 4020 – FALSE OR MISLEADING INFORMATION

3.1 Your visa application may be refused if you or any member of your family unit:

    • Fail to satisfy the Department as to your identity
    • Provide bogus documents
    • Provide information that is false or misleading

3.2 PIC 4020 may apply to:

    • Your current visa application, or
    • Any visa application made in the 12 months prior

3.3 Consequences may include:

    • A non-grant period of up to 10 years, or
    • A non-grant period of 3 years in certain circumstances

3.4 These consequences may also apply to members of your family unit.

  SECTION 5 – Evidence of date of birth, sex, gender and any changes of name, Photograph and signature
5.1 For change of date of birth:
5.1.1 Birth Certificate with both parents
5.2 If you cannot give us a birth certificate, provide:
5.2.1 a family or household registration document
5.2.2 any other collection of documents issued to you prior to your arrival in Australia that collectively confirm your identity from birth.
5.3 For change of sex and/or gender

Provide any one of the following:

5.3.1 a statement from a Registered Medical Practitioner or a Registered Psychologist which specifies your sex and/or gender
5.3.2 a valid Australian Government travel document, such as a valid passport, which specifies your sex and/or gender
5.3.3 any RBDM certificate that reflects the changed sex and/or gender, such as a gender recognition certificate, a revised RBDM birth certificate, a recognised details certificate or an identity acknowledgment certificate
5.4 For change of name

Provide any one of the following:

5.4.1 an official (non-commemorative) marriage or divorce certificate
5.4.2 change of name documents from an Australian Registry of Births, Deaths and Marriages, or the relevant overseas authority
5.4.3 other official documents that show links between names you have been known by.
5.5 Photograph and signature

Examples of documents include:

5.5.1 Australian driver’s licence
5.5.2 Pages from a valid passport (photo, personal details, passport issue and expiry dates)
5.5.3 National identity card
5.5.4 United Nations High Commission for Refugees (UNHCR) document
5.5.5 Document for travel to Australia (DFTTA)
5.5.6 Aircrew identity document
5.5.7 Seafarer identity document
5.5.8 Military identity document
5.5.9 Australian-issued proof of age card.
SECTION 6 – Evidence of residential address

Examples of home address documents include:

6.1 Electricity, gas or water bill

SECTION 8 – Supporting documents

You may need to give us extra documents to explain your current situation.

8.1 Evidence of Eligibility

Your eligibility depends on your situation. Provide the documents listed below that are relevant.

8.1.1 Medical evidence of an enduring physical or mental incapacity from a specialist medical practitioner registered in Australia
8.1.2 Medical evidence of permanent loss or substantial hearing, speech or sight impairment from a specialist medical practitioner registered in Australia
8.1.3 Proof of your birth in Papua before 16 September 1975 to an Australian citizen parent
8.1.4 Proof of your birth to a former Australian citizen who lost citizenship before 4 April 2002.
8.2 Evidence for exemptions, Ministerial discretions and concessions

Provide the documents listed below that are relevant to your situation.

8.2.1 A letter or discharge papers from the Australian Defence Force or Australian Reserve Force that states when you served
8.2.2 Proof of a departmental administrative error affecting your lawful or permanent residence status
8.2.3 A statement to support the claim that you would suffer significant hardship or disadvantage if we did not vary the residence requirement
8.2.4 A statement to support a claim that it would be unreasonable not to count time in a prison or psychiatric institution towards the residence requirement
8.2.5 Proof of the Australian citizenship of your living or deceased spouse or partner (birth certificate, citizenship certificate or passport)
8.2.6 Proof of your relationship (marriage certificate, joint utility accounts, joint bank accounts, joint tenancy agreements, joint mortgage agreements for de facto relationships, a statement explaining the reasons why you were both overseas, such as a letter from an employer and evidence of your close and continuing relationship with Australia)
8.2.7 Death certificate
8.2.8 Proof of the Australian citizenship of the person with whom you have an interdependent relationship and your close and continuing association with Australia and a statement explaining the reasons why you were overseas
8.2.9 Proof of eligibility for a fee concession or exemption.
8.3 Evidence to meet the special residence requirement

Provide the documents listed below that are relevant to your situation.

8.3.1 A letter from the Australian Olympic Committee, Australian Paralympic Committee, Tennis Australia or government agency providing evidence that you are seeking to engage in an activity, and that the organisation is supporting your application for citizenship
8.3.2 A letter of support from your employer confirming details of your employment as a member of a ship or aircraft crew, or your work on a resources or sea installation, including length of time in the role
8.3.3 Proof that although you have spent periods of time overseas, your home has been in Australia. Examples of proof may include the presence of a spouse or children in Australia, evidence of property, tenancy agreements, rates notices or income tax payments
8.4 Evidence of residence — British migrants

If you are a British subject without proof of entry to Australia and you arrived before 1 January 1975, you need to give us: For help with pre-1974 documents ask the National Archives of Australia.

8.4.1 Employment records

8.4.3 School records
8.5 Evidence of close and continuing link to Australia

Examples of evidence to show you have an intention to live or continue to live in Australia, or maintain a close and continuing link with Australia include:

8.5.1 A statement which explains your absence from Australia if you will be overseas for six months or more within the next few years
8.5.2 Employment contracts and pay slips
8.5.3 Share certificates, partnership agreements or business registration documents
8.5.4 Title deeds and leases for property
8.5.5 Receipts for payments associated with planned relocation, such as air fares or removalists
8.5.6 Letters confirming school enrolment, such as a school enrolment deposit receipt
8.5.7 Letters or statutory declarations from community organisations or from a board or committee of a club that sets out your contributions to that organisation
8.5.8 Passports, visa labels or national identity documents from countries outside Australia that shows the citizenship and migration status of immediate family members
8.5.9 A letter from an organisation showing you have been offered a study or sporting opportunity outside Australia which includes the details of this opportunity
8.5.10 Medical letters or other documentation showing you have been caring for a sick relative outside Australia
8.5.11 Air fares and airline tickets with a return date if you have been outside Australia on an extended holiday
8.5.12 A letter outlining how your relationship with extended family members in Australia allows you to maintain a close and continuing association with Australia
